The OfS monitors providers’ compliance with their ongoing conditions of registration. This includes compliance with general ongoing conditions as well as any specific ongoing conditions that we have applied to an individual provider.
We publish guidance for providers to tell them what they must submit to us (and when and how to do this) and to help providers to understand and meet our requirements.

Condition D: Financial viability and sustainability
The OfS has published guidance for providers on the submission requirements for condition D – see Regulatory advice 14
This regulatory advice and guidance sets out the information that a provider is required to submit as part of its annual financial return to the OfS. These documents expand on the elements of the F3 and F4 notice letter and schedule, issued on 31 July 2019, referring to the Finance Return and the Financial Forecasts and Student Projections. The deadlines for submission, as they apply to each provider, and details of how to access the bespoke workbook that the provider will need to complete and submit, will be issued to Accountable Officers.
The return applies to providers that are registered with the OfS in either the Approved or Approved (fee cap) category of the OfS Register. However, where a provider is a further education college or a sixth form college under the primary regulation of the Education and Skills Funding Agency (ESFA), it is not required to submit this financial data to the OfS. For such providers, the OfS works closely with the ESFA to ensure that it is able to undertake appropriate monitoring of financial viability and sustainability.
